These Terms of Service ("Terms") are a contract between you and SIMEX LLC ("we", "us"). They govern your access to and use of HydraScale.
By creating an account, signing in, or otherwise using HydraScale, you agree to be bound by these Terms and by our Privacy Policy. If you're using the Service on behalf of an organisation, you represent that you have authority to bind that organisation, and "you" refers to both you and the organisation.
HydraScale is a software-as-a-service operations dashboard that ingests data from third-party platforms you authorise (Shopify, Meta Ads, Google Ads, Google Drive, Gmail, euShipments, Triple Whale, Brevo and others) and consolidates it inside your tenant-scoped workspace.
We may change, improve or discontinue features at any time. We'll make reasonable efforts to notify you in advance of changes that materially affect the Service.

We may suspend access immediately if we reasonably believe these rules have been broken.
The Service depends on third-party platforms. When you connect one, you authorise us to access and process the scopes you grant on your behalf. Third-party platforms may change, throttle, or break their APIs at any time; we'll do our best to keep integrations working but we don't control them.
Your use of each third party is governed by that third party's own terms and privacy policy. In particular, your use of Google APIs through HydraScaleremains subject to Google's Terms of Service and Privacy Policy.
We offer a 14-day full refund on your first paid period if you're not satisfied — email support@hydrascale.io and we'll process it within 1 business day. After 14 days, fees already paid are non-refundable except where required by law (e.g. consumer-protection rights in the EU/UK). If we materially reduce the Service in a way that doesn't suit your needs mid-term, we'll pro-rate the remainder of your subscription on request.
Our IP. The Service — including the HydraScale name and logo, source code, designs, documentation and content we publish — is owned by SIMEX LLC and protected by IP law. We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for the duration of your subscription.
Your IP. You retain all rights to your data and content. You grant us a worldwide, non-exclusive, royalty-free licence to host, copy, transmit, display and process your data only as needed to operate the Service for you.
Feedback. If you send us product feedback, we may use it without restriction or compensation.
We handle your data as described in our Privacy Policy. We treat any non-public information you share with us as confidential and protect it with the same standard of care we use for our own confidential information.
The Service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
HydraScale is a reporting and operations tool — not financial, tax, or legal advice. Numbers shown in the dashboard can lag, be incomplete, or be inaccurate due to third-party API limitations. Verify before making decisions you can't reverse.
To the maximum extent permitted by law, neither party will be liable for indirect, incidental, special, consequential, exemplary, or punitive damages (including loss of profits, revenue, data, or goodwill), even if advised of the possibility.
Each party's total cumulative liability arising out of or related to these Terms is capped at the greater of (a) USD 100 or (b) the fees you paid us in the 12 months preceding the event giving rise to the claim.
Nothing in these Terms excludes liability that cannot lawfully be excluded — for example, liability for death or personal injury caused by negligence, or for fraud.
You agree to defend and indemnify us against third-party claims arising from your use of the Service in breach of these Terms, your content, or your violation of applicable law or third-party rights.
You can cancel any time in Settings → Billing; the cancellation takes effect at the end of the current billing period.
We may suspend or terminate your access immediately if you breach these Terms, fail to pay, present a security or legal risk, or if required to comply with law. Where it's reasonable to do so, we'll give you advance notice and an opportunity to cure.
On termination, you can export your data for up to 30 days. After that, we delete it as described in the Data Deletion Instructions.
These Terms are governed by the laws of State of Delaware, USA, without regard to its conflict-of-laws rules. The courts of State of Delaware, USA have exclusive jurisdiction, except that either party may seek injunctive relief in any competent court. Mandatory consumer-protection rights in your country of residence are not affected.
We may update these Terms from time to time. Material changes will be announced in-app and by email at least 14 days before they take effect. Continuing to use the Service after the effective date constitutes acceptance of the new Terms.
